Just saw an observation that Trump hasn't put up the money to appeal the recent Carroll ruling.

If he can't afford to appeal that judgement, he certainly can't afford to appeal one 5 times its size.

I still think the likeliest outcome is that SCOTUS rejects the appeal and lets the lower court's ruling stand. No guarantees of anything, but there's no circuit split to resolve, Trump's argument is really, really dumb, and IIRC Kavanaugh wrote the majority when they threw out his last attempt to claim (narrower) immunity.

Like I said, no guarantees of anything. They've agreed to take the appeal.

I still don't think they're likely to decide in his favor, but they're helping him delay his trial for no good damn reason, which is pretty fucking bad in itself!

I guess. I'm not sure why they'd feel obligated, though; there's no circuit split, the argument is dumb, the ruling is thorough, and they've already ruled against him on more limited claims of immunity.

I assume Thomas and Alito are all in but I'm kinda morbidly curious why two more signed on.

I think if they make him a king it will be indirectly, by helping him shunt this shit off until after the election, get reelected, and then just do whatever he wants.

I think there are a couple people on the court who take that as a positive, and maybe a few whose normalcy bias is strong enough that they don't think that's really what's going to happen. And Gorsuch seems the most prone to chase ideological consistency without regard for real-world results.

And it could just be noodling. Like, they could be taking it because it's something they want to write about. Kavanaugh in particular has a history with questions of presidential immunity and it could just be something he likes talking about.

Which isn't great either. These guys are far-right ideologues, but they're also ivory-tower intellectuals who are often more interested in discussing theory than worrying about what it's going to mean in real life.

Judge McAfee rules that Willis can continue with the Georgia prosecution provided Wade doesn't.

The case is appealable, by either side. Notably, McAfee's decision leaves the possibility open that if the appellate court decides to disqualify Willis, that doesn't necessarily disqualify the line prosecutors in the DA's office from continuing on without her.
